WARRANTY POLICY
(PUBLIC WARRANTY TERMS)

REGARDING WARRANTY SERVICE AND CLAIM RESOLUTION FOR PRODUCTS UNDER THE BLPRS TRADEMARK

1. GENERAL PROVISIONS

1.1. This Warranty Policy (Public Warranty Terms) regarding warranty service and the handling of claims for products sold under the BLPRS trademark (hereinafter referred to as the "Policy") determines the conditions and procedure for the Manufacturer to fulfill its warranty obligations regarding the respective products.

1.2. This Policy is publicly available on the official website of the BLPRS trademark: [blprs.com] and constitutes the Manufacturer's public warranty terms.

1.3. The terms of this Policy apply to all Buyers of BLPRS products unless otherwise provided by the legislation of Ukraine or by separate written conditions agreed upon by the Manufacturer. No provision of this Policy restricts consumer rights that cannot be limited by contract.

1.4. The provisions of this Policy apply to original products under the BLPRS trademark purchased from the Manufacturer or through official sellers, dealers, or other authorized partners, provided that such products are covered by the Manufacturer's warranty obligations.

1.5. This Policy defines:

Conditions for warranty service of BLPRS products;

The warranty period;

The product storage period prior to sale;

The procedure for submitting and reviewing claims;

The procedure for conducting warranty diagnostics;

The product replacement procedure;

Cases not covered by warranty obligations;

Specifics of operating products equipped with the BLPRS protection system.

2. DEFINITIONS OF TERMS

2.1. In this Policy, the following terms have the following meanings:

"Manufacturer" — the legal entity that physically manufactures the products sold under the BLPRS trademark and fulfills warranty obligations in accordance with this Policy.

"BLPRS" — the trademark under which the respective products are labeled, positioned, and sold.

"Seller / Official Seller / Dealer" — a business entity that sells BLPRS products to the final Buyer. Unless otherwise separately agreed in writing with the Manufacturer, such a seller is not the Manufacturer's warranty service center and does not make technical decisions regarding the presence or absence of a warranty case.

"BLPRS Products" — protective footwear equipped with the BLPRS multi-layer protection system, designed to reduce the overall degree of injury and the severity of consequences for the foot and lower extremities in the event of an explosion involving a PFM-1 anti-personnel mine.

"Buyer" — an individual or legal entity that has purchased BLPRS products directly from the Manufacturer or through a Seller, official dealer, or other authorized partner. The rights of a Buyer who is a consumer within the meaning of Ukrainian legislation are also determined by the relevant consumer protection laws.

"Warranty Period" — the period established by the Manufacturer during which the Manufacturer fulfills warranty obligations regarding the products in accordance with this Policy.

"Warranty Case" — a manufacturing defect established by the Manufacturer based on the results of an inspection, which occurred due to reasons for which the Manufacturer is responsible, and which was detected during the warranty period.

"Warranty Card" — a document confirming that the Manufacturer's warranty obligations apply to a specific product and containing the information specified in this Policy.

"Claim" (Reclamation) — an appeal by the Buyer to the Manufacturer regarding a discovered flaw or defect in the product, containing a demand for warranty service.

3. STATUS OF THE POLICY AND ITS APPLICATION

3.1. This Policy constitutes the Manufacturer's publicly available warranty terms and applies to original BLPRS products in the cases defined herein.

3.2. The full text of the Policy is permanently available to the Buyer on the official website of the BLPRS trademark.

3.3. Purchasing the product from a third party — a Seller or dealer — does not imply the conclusion of a purchase agreement directly with the Manufacturer. At the same time, the Manufacturer assumes warranty obligations for original BLPRS products within the scope of this Policy and the legislation of Ukraine.

3.4. Warranty service and technical review of claims regarding BLPRS products are centrally carried out by the Manufacturer unless expressly specified otherwise in writing.

3.5. Official sellers and dealers must inform the Buyer about the procedure for contacting the Manufacturer and, subject to separate agreement, facilitate the transfer of information or products; however, they are not authorized to independently determine the presence or absence of a warranty case.

3.6. The organizational procedure for warranty service established by this Policy does not limit the Buyer's rights, which, in accordance with mandatory norms of Ukrainian legislation, can be exercised directly against the seller of the products.

4. SUBJECT OF THE POLICY

4.1. The Manufacturer assumes warranty obligations for original products sold under the BLPRS trademark in accordance with the terms of this Policy.

4.2. Within the scope of warranty obligations, the Manufacturer conducts a free review of the submitted claim and, upon confirmation of a warranty case, fulfills the warranty obligations in the manner prescribed by this Policy and the legislation of Ukraine.

4.3. Warranty obligations cover exclusively manufacturing defects in the products unless otherwise expressly provided by the legislation of Ukraine.

5. WARRANTY PERIOD

5.1. The warranty period for BLPRS products is 6 (six) months from the date of sale to the final Buyer.

5.2. The date of sale is confirmed by a properly executed Warranty Card and/or other documents that, under the law, can confirm the fact and date of product purchase.

5.3. Warranty obligations remain valid provided the product is used for its intended purpose and the Buyer complies with the rules of operation, care, and storage.

5.4. The warranty period established by this Policy does not limit other rights of the Buyer provided by the applicable legislation of Ukraine.

6. PRODUCT STORAGE PERIOD PRIOR TO SALE

6.1. The product storage period prior to its sale is 24 (twenty-four) months from the date of manufacture, provided that the storage conditions established by the Manufacturer are met.

6.2. The date of manufacture is considered to be the date indicated on the product labeling, packaging, or accompanying documentation, which allows the reliable determination of the manufacturing date.

6.3. Upon expiration of the established storage period, the product must not be sold until a proper inspection of its condition is conducted, confirming the possibility of further storage and sale.

6.4. The product storage period may be prolonged by the Manufacturer after relevant inspections and an assessment of the actual condition of the product.

6.5. The decision to prolong the storage period is made by the Manufacturer and, if necessary, is formalized by a corresponding document indicating the extended storage period and additional conditions.

6.6. Products whose condition, based on the inspection results, does not meet the established requirements are not allowed to be sold.

6.7. The product storage period prior to sale is not a warranty period and does not replace or reduce the warranty period defined in Section 5 of this Policy.

7. WARRANTY CARD

7.1. The Warranty Card is a document that ensures the identification of a specific product and confirms the application of the Manufacturer's warranty obligations to the respective product.

7.2. The Warranty Card must include, among other things:

Product name and/or model;

Size;

Date of sale;

Seller's details;

Unique barcode of the left shoe (half-pair);

Unique barcode of the right shoe (half-pair);

Other details provided for by the Warranty Card format.

7.3. The Buyer is obliged to verify the accuracy of the data specified in the Warranty Card.

7.4. Any discovered errors or discrepancies must be corrected before the purchase is finalized.

7.5. The absence of certain details in the Warranty Card does not in itself deprive the Buyer of the rights expressly guaranteed by the legislation of Ukraine.

8. UNIQUE PRODUCT MARKING

8.1. Each left and right shoe of the BLPRS footwear features a unique barcode applied directly to the footwear.

8.2. Information regarding the unique barcode is additionally duplicated inside the footwear to ensure the possibility of identifying a specific shoe, particularly in case of damage, abrasion, or loss of external marking.

8.3. Unique marking is used to establish the origin and identity of a specific product.

8.4. In the event of reasonable doubts regarding the product's compliance with the Warranty Card, the Manufacturer has the right to conduct an additional verification of its origin and identity.

8.5. If the product cannot be identified, the Manufacturer conducts an additional inspection taking into account all available evidence and documents.

9. BLPRS PROTECTIVE PROPERTIES

9.1. The BLPRS system is a multi-layer protective system designed to reduce the severity of consequences of a blast impact on the foot and lower extremities, particularly during an explosion involving a PFM-1 anti-personnel mine. Comprehensive experimental tests have confirmed the effectiveness of the reinforced footwear prototype in reducing the severity of blast injuries to the foot.

9.2. The BLPRS protective system does not guarantee complete injury prevention.

9.3. The Manufacturer does not guarantee 100% protection against injury, including severe or fatal injuries, in the event of an explosion involving a PFM-1 or other explosive devices.

9.4. The actual nature and degree of injury may depend on the type and power of the explosive device, its placement, the distance to it, soil characteristics, the position of the person's foot and body, the nature of the contact with the explosive device, and other circumstances.

9.5. The results of the BLPRS system testing cannot be construed as a guarantee of an identical level of protection under any conditions of explosive impact.

10. STATE TESTING

10.1. Products equipped with the BLPRS protection system have undergone state military testing by the commission of the Medical Forces of the Armed Forces of Ukraine.

10.2. Based on the testing results, BLPRS products are recommended for provision and adoption for supply within the Security and Defense Forces of Ukraine.

10.3. The testing results confirm the declared characteristics of the products in accordance with the applied methods and testing conditions, and cannot be interpreted as a guarantee of an identical result under any other operating conditions or explosive impacts.

11. MANDATORY DECOMMISSIONING AFTER AN EXPLOSION

11.1. In the event of an explosion involving a mine or other explosive device, the BLPRS footwear must be immediately withdrawn from use.

11.2. After an explosive impact, the protective resource of the footwear is considered exhausted, regardless of the presence or absence of visible damage.

11.3. Repair, restoration, replacement of individual elements, or other intervention in the design after an explosive impact do not restore the initial protective properties of the BLPRS system.

11.4. Such footwear cannot be reused as protective gear.

11.5. The mere fact of damage or destruction of the product resulting from a blast, explosion, or other extreme mechanical impact does not constitute a warranty case. This provision does not preclude the review of a claim regarding a potential manufacturing defect if the Buyer asserts the presence of such a defect.

12. WARRANTY CASES

12.1. The warranty covers manufacturing defects that arose through the fault of the Manufacturer and were discovered during the warranty period.

Such defects may include, in particular:

Defects in materials of manufacturing origin;

Defects in seams and joints caused by the manufacturing process;

Premature destruction or delamination of elements, provided it has a manufacturing origin;

Manufacturing defects of the sole;

Other defects that, based on inspection results, are determined to be of manufacturing origin.

12.2. Based on the results of the claim review and, if necessary, the physical inspection of the product, the Manufacturer makes a decision regarding the recognition of the claimed case as a warranty case and notifies the Buyer thereof. This decision is the result of the Manufacturer's warranty procedure and does not limit the Buyer's right to other methods of protection provided by Ukrainian legislation.

13. CASES NOT COVERED BY WARRANTY OBLIGATIONS

13.1. Warranty obligations do not apply to defects and damage resulting from:

Mechanical damage resulting from external impact and not related to a manufacturing defect of the product;

Use of the product for other than its intended purpose;

Improper or incorrect use;

Exposure to high temperatures, open flames, or excessive heating;

Improper drying;

Unauthorized repair, disassembly, modification, or alteration of the design;

Natural wear and tear;

Improper care or storage;

Mine blast, explosion, or other extreme impact.

13.2. Natural wear and tear, scuffs, scratches, color changes, staining, alterations in appearance, and other consequences of operation that do not possess the characteristics of a manufacturing defect are not considered manufacturing defects.

13.3. At the same time, the provisions of this section do not restrict the Buyer's rights that cannot be limited by contract under the legislation of Ukraine.

14. RULES OF OPERATION AND CARE

14.1. To preserve the functional and protective properties of the product, the Buyer is obliged to:

Use the footwear strictly for its intended purpose;

Use footwear of the correct size;

Prevent intentional damage to the product;

Adhere to the requirements of the Operation and Care Manual;

Dry the footwear naturally or by the method recommended by the Manufacturer;

Store the footwear in a dry place, protected from excessive moisture, direct sunlight, and excessive heat.

15. CLAIM SUBMISSION AND REVIEW PROCEDURE

15.1. A warranty claim regarding the quality of BLPRS products is submitted directly to the Manufacturer using the contact details provided in the Warranty Card and/or on the official BLPRS trademark website.

15.2. Official sellers and dealers, including the Authorized Partner, unless expressly agreed otherwise in writing with the Manufacturer, do not conduct a technical review of warranty claims and do not make decisions on whether a case is recognized as a warranty or non-warranty case. They may provide the Buyer with the Manufacturer's contact details and information about the application procedure.

15.3. The exchange or return of products of adequate quality for reasons unrelated to a manufacturing defect, in particular, if the size, fit, or other consumer characteristics did not suit the Buyer, does not constitute a warranty claim and is carried out through the Seller from whom the product was purchased, in accordance with Ukrainian legislation and the rules of such Seller.

15.4. For the preliminary review of the claim, the Buyer must provide:

The Warranty Card or its copy/photograph;

Photographs of the defect or damage;

A brief description of the detected defect and the circumstances of its occurrence;

Other documents or information that may be relevant to the review of the claim.

15.5. The Manufacturer conducts a preliminary review of the provided materials and informs the Buyer of the further procedure for reviewing the claim within a timeframe that complies with Ukrainian legislation and the required scope of verification.

15.6. Based on the preliminary review, the Manufacturer has the right to request the Buyer to provide the product for physical inspection.

15.7. If physical inspection is necessary, the Buyer ships the product to the Manufacturer in accordance with the procedure and to the address provided by the Manufacturer. If the warranty case is confirmed, the Manufacturer shall compensate the Buyer's documented and justified expenses for delivering the product for the warranty review, or the delivery shall be organized at the Manufacturer's expense.

15.8. The Manufacturer has the right to conduct diagnostics, inspection, research, or other necessary verifications of the product to determine the causes of the claimed defect.

15.9. Based on the results of the conducted verification, the Manufacturer makes a decision regarding the recognition of the claimed case as a warranty case and informs the Buyer of the review results.

15.10. If the warranty case is confirmed, the Manufacturer fulfills the warranty obligations in accordance with Section 16 of this Policy and the requirements of Ukrainian legislation.

15.11. If it is established that there is no manufacturing defect or that there are circumstances not covered by warranty obligations, the Manufacturer provides the Buyer with a reasoned written or electronic response.

16. CLAIM REVIEW RESULTS AND FULFILLMENT OF WARRANTY OBLIGATIONS

16.1. If the warranty case is confirmed, the Manufacturer fulfills the warranty obligations in a manner corresponding to the nature of the established defect, this Policy, and the requirements of Ukrainian legislation. If product replacement is an applicable method, it is carried out in accordance with paragraphs 16.2–16.3.

16.2. Replacement is made with a product of the same model and size, subject to the availability of such a product, and provided that this method of fulfilling the warranty obligation complies with legal requirements.

16.3. In the absence of the same model, a replacement with another model is permitted upon agreement with the Buyer, provided its characteristics and level of protective properties are no lower than those of the product being replaced, and this option complies with the requirements of Ukrainian legislation.

16.4. If additional research or testing is required to determine the causes of the defect, the claim review period is determined taking into account the necessary scope of such procedures and the requirements of Ukrainian legislation.

17. SPECIAL PROVISIONS REGARDING THE BLPRS PROTECTIVE SYSTEM

17.1. BLPRS is a multi-layer protective system specially designed to mitigate the consequences of blast impact.

17.2. It is strictly prohibited to independently disassemble, alter the design, modify, or repair elements of the BLPRS protective system.

17.3. Any unauthorized intervention in the design of the protective system may lead to a change in its functional and protective properties.

17.4. In the event of a damaged or defective component that may affect the product's protective properties, the operation of the footwear must be suspended, and the Manufacturer must be contacted.

17.5. It is prohibited to replace the insert insole included with the BLPRS Product with any other insole that is not intended by the Manufacturer for use specifically with this footwear model.

17.6. Replacing the insert insole may affect the design characteristics of the footwear and its level of protective properties.

18. PERSONAL DATA

18.1. When the Buyer submits a warranty claim to the Manufacturer, the Manufacturer has the right to process the personal data provided by the Buyer exclusively to the extent and for the purposes necessary for product identification, claim review, fulfillment of warranty obligations, and compliance with legal requirements.

18.2. Personal data processing is carried out in accordance with the legislation of Ukraine.

19.3. The Buyer has the right to:

Not carry out unauthorized interventions in the design of the product;

Provide accurate information when submitting a claim.

20. POLICY VALIDITY PERIOD AND AMENDMENTS

20.1. This Policy comes into force from the moment it is published on the official website of the BLPRS trademark, unless otherwise specified directly in its text.

20.2. The Manufacturer has the right to amend this Policy in compliance with the requirements of Ukrainian legislation.

20.3. A new version of the Policy takes effect upon its publication on the BLPRS trademark website, unless otherwise established by the new version itself.

20.4. Products purchased before the new version of the Policy takes effect are subject to the warranty terms that were in effect at the time the product was purchased, unless otherwise provided by Ukrainian legislation.

21. LIABILITY AND APPLICABLE LAW

21.1. The Manufacturer and the Buyer bear responsibility in accordance with the legislation of Ukraine and this Policy.

21.2. No provision of this Policy may be interpreted as depriving the Buyer of the rights guaranteed by the mandatory norms of Ukrainian legislation.
